1. INTRODUCTION

1.1 These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. By entering the prize draw (the "Promotion"), all participants will be deemed to have accepted these Terms and Conditions in full. All entry instructions form part of these Terms and Conditions. 1.2 The promoter is Haringtons Hairdressing, 13-15 High Street, Marlow, SL7 1AU.

1.3 The Promotion is open to mainland UK residents aged 18 or over at the date on which they enter the promotion.

1.4 Entry to the Promotion opens on 1st December 2023 and closes 23:00 15th December 2023 (the “Promotion Period”). No entries received after the Promotion Period has ended will be eligible to win the prize(s).

1.5 Internet access required.

2. ENTRY TO THE PROMOTION

2.1 Follow, Like and Tag a friend to our Instagram post on our Instagram account Haringtonshair. Entries submitted to any posts that are not part of this promotion will not be included in the prize draw.

2.2 Only the entrant who has interacted ad responded to the post for the Promotion will be entered into the prize draw. Anyone trying to circumvent this rule by using alternative details including but not limited to creating multiple accounts will be disqualified from this promotion.

2.3 Internet access is required, and entrants must have an active Instagram account. If you do not have an account, you will need to create one to participate – you will require an active email address to do this.

2.4 You must continue to keep your submission (comment) on a public setting for 2 weeks after the end of the Promotion Period to be contacted if you are selected as a winner.

2.5 Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

2.6 The Promoter monitors responses to this promotion and if any responses or any previous posts made by an entrant are, or could be regarded, as being disrespectful towards other members of the Instagram community or which contain anything which is likely to, or could cause offence or distress will be removed from the promotion. 2.7 Participants’ entries will be deemed invalid if any post:

·       contains defamatory, malicious, indecent or other inappropriate content;

·       includes the names of any individual without their express permission;

·       in the reasonable opinion of the Promoter, cause any widespread or serious offense (taking into account prevailing community views or standards);

·       contains content deemed socially irresponsible or likely to breach the CAP Code

3. THE PRIZES

3.1 The selected winner will receive a Kerastase Gift Set to be sent to their address from Haringtons Hairdressing Head Office.

3.2 There are no Prize substitutions and the Prize(s) are not transferable.

4. WINNERS

4.1 We will review all entries received by us which comply with these Terms and Conditions and winners will be chosen by random selection.

4.2 Winners will be notified via direct message to the social media account they entered and liaise with Haringtons Hairdressing Marketing team on final details.

4.3 Winners will be contacted by direct message by Haringtons Hairdressing within 5 working days and will have 5 days to confirm details (name and contact number) to claim prize. In the case that they do not respond in time or are ineligible, another winner will be selected using the same methodology as above.

4.4 You agree that if you are a Winner:

(a) you consent to us using your name and/or ad in our publicity for the Promotion and in such promotional materials relating to our Christmas promotion on Haringtons Hairdressing social media channels

5. CONDITIONS

5.1 In the event that we are unable to contact a winner within 2 working days of the draw, the prize is rejected, or the winner is ineligible, we reserve the right to award the prize to an alternative winner selected at random by computer from all remaining eligible entries. The process will repeat until an eligible winner is able to claim the prize. Entrants are encouraged to monitor their Instagram account during this time in case they are the winner.

5.2 The prize will be fulfilled within 30 working days from a valid acceptance of the prize.

5.3 Should the prize be unavailable due to circumstances beyond our control, no prize will be issued.

5.4 It is the responsibility of the entrant to provide correct, up-to-date details when accepting the prize. The Promoter cannot be held responsible for winner’s failing to supply accurate information which affects prize acceptance or fulfilment of their prize.

5.5 No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are permitted, and no bulk entries.

5.6 All costs and expenses are not included within the prizes and are the responsibility of the winner(s).

5.7 Haringtons Hairdressing reserves the right at any time, in its absolute discretion, to:

5.8 verify the eligibility of any participant (including their age and place of residence);

5.9 disqualify any participant found to be abusing or tampering with the operation of the Promotion or entering/winning using fraudulent means, or who the promoter believes to have acted in breach of these Terms and Conditions.

5.10 disqualify participants who do not give correct contact details or those who make an entry on someone else's behalf

6. LIABILITY

6.1 Except as otherwise required by applicable law, the promoter accepts no responsibility or liability for any entry or claim which, for technical or other reasons, is unsuccessful, incomplete, lost, late, damaged, corrupted, or misdirected. The promoter shall not be liable for a failure to fulfil this Promotion or for any breach of these Terms and Conditions caused by events or circumstances beyond its reasonable control.

6.2 The promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

7.2 Numerous factors outside the control of the promoter may interfere with the operation of this promotion. The promoter does not therefore guarantee continuous, uninterrupted, or secure access to this website.

7.3 This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. By entering the promotion, all participants accept that they have no claim against Instagram. By entering the promotion, all participants agree to a complete liability release for Instagram.

7.17.4 Any tax liability arising from receipt of the prize will be the responsibility of the recipient.

7.27.5 In the event of circumstances outside the reasonable control of the promoter, or otherwise where fraud, abuse, and/or an error affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, the promoter reserves the right to cancel or amend the promotion or these Terms and Conditions, at any stage, but will always endeavour to minimise the effect to participants in order to avoid undue disappointment The promoter reserves the right to extend, withdraw, alter or suspend the Promotion or these terms and conditions at any time if circumstances beyond its control make this unavoidable.

7.37.7 The promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

7.47.8 All personal data submitted in connection with the Promotion will be processed by the promoter for the purposes of administering and managing the Promotion and prizes (where applicable) and verifying the eligibility of each participant. 7.9 If you are a winner of the Promotion, the promoter may use your surname and county of residence to members of the public or regulators who request such details within 3 months of the closing date of this Promotion and announce the winners of the Promotion. Please contact us via enquiries@haringtons.com if you do not want us to make your details available in this manner (if so, please note that the promoter may nonetheless be obliged to provide details of the prize winners to the Advertising Standards authority and other regulators).

7.10 If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

7.11 The Promotion and these terms and conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with English law and you can bring legal proceedings in respect of the Promotion and these terms and conditions in the English and Welsh courts. If you live in Scotland, you will also benefit from any mandatory provisions of Scottish law and can bring legal proceedings in respect of the Promotion and these terms and conditions in either the Scottish or the English courts.
